Well water suit unresolved

WINDSOR — A three-year-old lawsuit claiming contaminated drinking water remains unresolved, although both sides in the case say the water quality today is acceptable.

Charles and Audrey Cogswell of Legion Park Road sued neighbor David Coombs in Kennebec County Superior Court, alleging a plume of leaking gasoline fouled the couple’s well with MTBE, a gasoline additive that is considered a health hazard in drinking water.

Tests three years ago showed a small amount of MTBE in the well water, well within safety standards. A much higher amount, beyond safe levels, was detected behind the Cogswell’s home, according to a geologist investigating the case.

Tests now show the Cogswell’s water is safe, but Augusta lawyer Roger Katz, representing the Cogswells, said the value of their property has been decreased by alleged pollution and he is still seeking financial damages from Coombs.

Meetings between the parties to try to resolve matters out of court are continuing, Katz said.
