SKOWHEGAN — Attorneys for murder suspect Shannon Atwood argued during a bail hearing Friday that the charges against him are not supported by enough evidence.
Attorney John Alsop said that although Atwood has been indicted by a grand jury, law requires there be a judicial finding of probable cause. He argued that there is not enough evidence to support the charge, much less a conviction.
At the conclusion of the almost three-hour hearing in Somerset County Superior Court, Justice Nancy Mills said she would “take under advisement” whether to make a determination that the state had proved its case of probable cause.
If she makes a decision for probable cause, Atwood’s right to bail would be extinguished. A judge could still choose to set bail, however. Either way another hearing would be set to argue bail.
Atwood, of Canaan, has been charged with the murders of two women in 2006, Cheryl Murdoch of Waterville — his live-in girlfriend whose body was found Aug. 11 in a remote area off Scott Road in Canaan — and his wife, Shirley Moon Atwood, whose body has never been found.
