Witnesses say Calais man shot at police

INDIAN TOWNSHIP - Maine state police and the attorney general's office are investigating the fatal shooting by police of a 40-year-old Calais man on the Passamaquoddy Tribe's reservation in far eastern Maine.

The Bangor Daily News reported that two neighbors said Douglas Kelley had shot at police.

The attorney general's office confirmed Tuesday that Passamaquoddy Tribal Warden Scott Francis and Indian Township police Officer Alexander Nicholas II fired at Douglas Kelley, who was pronounced dead at the scene Monday night.

Francis, Nicholas and two other township officers — Police Chief Alex Nicholas, who is the father of Alexander Nicholas II, and Officer James Mendoza — have been placed on paid administrative leave pending the outcome of the investigation by the attorney general's office, which released no further information.

The shooting happened Monday evening.

According to the Daily News, Janet Neptune said she saw Kelley outside a house across the street when she got home.

"I was walking up my way and I heard a gunshot and I couldn't get in my house quick enough," she said.

Neptune said she heard a couple of more shots and soon police showed up. She said Kelley fired on the officers, the newspaper reported.

"They had to shoot him," Neptune said.

The Daily News said another neighbor also witnessed what happened. Wade Bushey said he too had seen Kelley sitting on a rock holding a gun and that when other people walked by and noticed the gun, "they all scattered out and someone called police."

Bushey told the newspaper that "police showed up and asked him to put the gun down. After a while he aimed the gun at the cops and fired one shot. The cops fired shots back."

The Daily News reported that First District Attorney Paul Cavanaugh of Calais, who prosecuted Kelley in a domestic assault case, said Kelley was on probation when he went to the reservation Monday.
