Former Biddeford official sent back to jail

A former municipal official in Biddeford and Wells was sentenced to 30 months in jail today for violating the conditions of his probation.

Donald Simard, 56, served 14 months in jail beginning in 2001, for sexually assaulting a 10-year-old relative in 1998.

Simard had worked as Biddeford’s code enforcement officer for 12 years, and was town planner in Wells prior to the charges being brought.

His probation for the crime was due to expire in 2009. Prosecutors said Simard violated his probation recently by downloading thousands of pornographic images to his home computer, and for failing to register as a sex offender. The images were discovered during a random check of his computer equipment.

Assistant District Attorney Julia Sheridan asked Superior Court Justice William Broderick to send Simard back to jail for the remaining five years of his original sentence. Defense attorney Robert Ruffner asked for leniency, because of the nature of the probation violation.
