Assault conviction nets 30 months in prison

AUGUSTA - Threatening a roommate with a gun has cost a Waterville man 30 months behind bars.

A judge today sentenced Michael Fitzsimmons, 26, to a five-year prison term, then suspended all but 30 months of it, and ordered him to spend two years on probation.

On Aug. 21, a jury in Kennebec County Superior Court had convicted Fitzsimmons of criminal threatening with a dangerous weapon and assault, and the case was continued until today for sentencing.

At the trial, Fitzsimmons said the victim had lived at his home briefly and he wanted her to leave because she and anther woman argued constantly.
He testified he had a gun at his Gold Street home because he had been the victim of three previous break-ins.

Fitzsimmons also pleaded guilty Thursday to a bail violation charge.
