A State Police trooper who shot to death a man in Albion was legally justified in the shooting, the attorney general concluded in a report issued this afternoon.
Attorney General Steven Rowe determined that Trooper Derrick Record was legally justified when he shot Johnathan T. Sullivan, 34, the night of Aug. 4. on Main Street in Albion.
The attorney general's investigation determined that Record was called to a house in Albion for a report of a domestic disturbance in which a gunshot was fired.
Minutes after Record arrived, Sullivan came from behind his house and was walking toward Record, refusing to drop a loaded shotgun he was carrying.
The report says that Record shot Sullivan as Sullivan was raising the shotgun to point it at the trooper.
Tests by the state Medical Examiner found Sullivan had a blood alcohol content of .24 and had marijuana in his system.
