Two tenants reach deal with landlord Soley

Old Port landlord Joseph Soley has reached an agreement with two of the tenants who are being forced out of their apartments at 10 Exchange St.

But the details of the arrangement have not been made public, because the parties signed a confidentiality agreement. And the fate of several other residents at the building remains unclear this afternoon, as they have just two days remaining to vacate.

Portland city officials are forcing the moves because the building does not meet safety codes, and Soley has not heeded the city's demands for him to upgrade sprinkler and fire alarm systems.

Jessica Parker and Jason Austin, through an attorney with Pine Tree Legal Assistance, sued Soley on Thursday, claiming that Soley's failure to properly maintain the property has led to their forced eviction. Residential tenants in 24 units at the building have been ordered to leave the premises by Monday.

In the lawsuit, Parker and Austin demanded assistance with a move to a new apartment, and immediate repairs to the 10 Exchange St. property.

Their lawyer, Katie McGovern, told District Court Judge Peter Goranites at a hearing today that she has dropped the lawsuit against Soley.

"All I can say is it was resolved to the mutual satisfaction of the parties," McGovern said.

Because of the confidentiality agreement, McGovern declined to comment on what concessions Soley made, if any, to her clients. Soley's lawyers, Susan Rockefeller and Sidney St. F. Thaxter, also declined comment after the hearing.

Gary Wood, Portland's city attorney, said he believes all of the residential tenants will be moved out by Monday. If that doesn't happen, Wood said he will be back in court to request an order to have them removed.

The 12 businesses on the first two floors of the building are not being asked to move out immediately.
