PORTLAND -- The Maine Supreme Court has tossed out the drug trafficking conviction against a pub owner because a search warrant used in the case was based on evidence obtained from an inspection by state liquor enforcement officials.
Dayle Lynn Johnson, operator of the Village Pub in Parsonsfield, contends her Fourth Amendment rights were violated by the search.
The Maine Supreme Judicial Court ruled today that state liquor inspectors exceeded the scope of a valid regulatory inspection.
Johnson entered a conditional guilty plea depending on the outcome of her motion to suppress evidence. She's charged with trafficking and cultivating marijuana.
